  • the licensee is prohibited from holding a licence under the Immigration Advisers Licensing Act;
  • the licence was granted on the basis of false or fraudulent information;
  • the licence or renewal application fee (or Adviser's levy) was paid by means that have subsequently been dishonoured; or
  • the licensee has died.

Advisers who breach the code of conduct can also have their licences cancelled by the Immigration Advisers Complaints and Disciplinary Tribunal.

Comments - The adviser’s licence was suspended in terms of an order issued by the Immigration Advisers Complaints and Disciplinary Tribunal on 3 November 2020 ([2020] NZIACDT 47). At the time of the Tribunal’s order the adviser had a licence renewal application in progress, which allowed her to continue to practice. As of 3 November 2020 she is no longer entitled to lawfully provide immigration advice. On 25 July 2022 the Tribunal cancelled the adviser’s licence with immediate effect ([2022] NZIACDT 19).
